Conditions of participation Instagram

  1. Organizer
    Growing Imaginations GmbH, Friedrichstr. 114A, 10117 Berlin (hereinafter referred to as "Funzy").

  2. Eligibility
    The competition is open to anyone aged 18 or over who is a permanent resident of the European Union and follows the Instagram account @myfunzy.

  3. Participation
    To take part in the competition, the:participant:must like and comment on the competition post on the Instagram page @myfunzy and answer the question or task posed. A valid Instagram profile is required. Each person may only participate once. Funzy reserves the right to disqualify participants who manipulate the competition or violate these conditions of participation. Suspicion of manipulation or rule violations may also lead to disqualification.

  4. Entry period and prizes
    The competition runs from x, to x, on the Instagram account @myfunzy. The prize draw is x. The winners will be chosen at random from the comments after the end of the competition. Multiple comments do not increase the chances of winning. The winners will be notified by direct message. The winners must send their full contact details (name and postal address) by direct message to @myfunzy within two days. If this is not done in time, a new winner will be drawn. The prizes will be sent by post, a cash payment is excluded.

  5. Data protection
    The data collected as part of the competition (Instagram name, name and postal address of the winner) will only be used to carry out the competition. The legal basis is Art. 6 para. 1 b) GDPR. The winners' contact details will be deleted four weeks after the end of the competition. Instagram names and comments will be retained and remain visible to third parties unless they are deleted by the participants. The data collected will only be passed on to service providers who support Funzy in running the competition (e.g. agencies, shipping companies, IT service providers). In exceptional cases, data may be transferred to countries outside the EEA, in particular to the USA, provided that appropriate data protection guarantees exist in accordance with Art. 46 GDPR. Participants have the right of access, rectification, erasure, restriction of processing, objection to processing and data portability as well as the right to lodge a complaint with the competent supervisory authority.

  6. Final provisions
    The law of the Federal Republic of Germany applies. The competition is not affiliated with Instagram and is neither sponsored, supported nor organized. Instagram is not the recipient of the information provided. Participants indemnify Instagram against any claims arising in connection with the implementation of the competition. Questions or complaints should be addressed directly to Funzy, not to Instagram.
